Please Read: what should i do?

I have diabetes and its been a few days since i last remembered to do my shots. So i went to google to search what are the reactions and such of forgetting shots over a couple days and was shocked at what I found. There was an article discussing the links between Sleep Apnea (which I also have) and certain forms of diabetes in adult males. So, interested, i clicked said link and, staring back at me, ME. yes. me.

now at the bottom of the article they include a reference box with the phrase : Image provided by Gh0stM1ck and includes a hyperlink back here to my DA page.

the photo seen here is one that I uploaded in January of this year as part of a horror or mood themed photography. you can see the original entry here: [link]

so what do you guys think? Should I be flattered that this site used one of my images- meaning that it is good enough for professional use. Or should I be pissed off that they never contacted me directly for permission. I list here on DA at least 3 different ways of contacting me and i regularly check even my Junk bin when working with e-mail.

for what its worth I don't care about compensation or anything like that, but if they use my work I'd rather they credit my actual name instead of an internet handle. so hit me back with your thoughts.

Tell them to remove the image and threaten to sue them otherwise. It's not legal to post artwork without the artist's permission.

Yeah, they should have asked you first. But, it's kinda cool they chose your picture and the feature's probably giving you some pageviews on the up side.

You have the right to even sue them for taking the picture. They had NO right to do that. and btw waaay creepy! i think you should confront them at the least!

I'd send them an email and ask them to a) change the credit b) link to it here and c) contact you next time.

If I remember correctly, the law with regard to images online changed recently, maybe for the worse. I believe there's now a requirement that you have to request removal from a website before you can sue. If they agree and take it down then you don't have any legal recourse for compensation. I think that was part of the DMCA. I could be wrong tho, you'd have to ask an IP attorney to be certain.

i should probably put up a new new journal about this. I emailed the site Admin and apparenlty my stuff showed up in a search engine developed for CC Liscenced material (despite me saying NO when I uploaded the stuff) and they assumed it was free to use. I explained to him that it was, in fact, registered and copyrighted material that was not written to be used freely. I aske dhim to change the cred from Gh0stMqck to my given name and they complied.

Well that's cool on a couple of fronts. Because a) you got the credit, and b) the legalities may be a bit different if they found it in someone else's published archive of supposed to be CC material. It may be that the site is just assuming all content on DA to be in the public domain, in which case there might be grounds for a class action suit amongst a large number of DA artists who might now be having their material unknowingly ripped. I definitely think that's something that ought to be looked into. There's no knowing how extensive it might be.
